SPC expert evidence: Judge stays proceedings as an abuse of process

It was a privilege for SPC to be appointed by GT Stewart to give expert evidence in a case of three Vietnamese males accused of producing cannabis.

The three accused, all Vietnamese adult males, were beaten, threatened and held to ransom – forced to work in atrocious conditions. All three told the police they had been trafficked and forced to work in the cannabis farm, but the police and subsequently the CPS, failed to investigate their allegations.

Having been appointed by GT Stewart Solicitors to provide expert opinion on the matter, the team from SPC proceeded to comprehensively review all the Crown’s evidence.  This revealed significant failings by the Crown which breached the defendant’s human rights under Articles 4 and 6 of the ECHR.  There was clear evidence that all three males were the victims of human trafficking.

Following service of our expert statement, and representations by the defence barristers, the Judge dismissed the case.
